Common Questions
Frequently asked questions
Do I need to go to court to resolve a family law matter in Ontario?
Many family law matters can be resolved through negotiation or mediation, including parenting arrangements, support and property issues. If an agreement cannot be reached, or urgent protection is needed, court proceedings may be necessary. A lawyer can help you understand your options.
How are parenting arrangements decided in Ontario?
Parenting time and decision-making responsibility are determined based on the child’s best interests. Factors include the child’s needs, relationships, history of care and any family violence. There is no automatic entitlement to equal parenting time.
How is child support calculated in Ontario?
Child support is generally calculated using the applicable Child Support Guidelines. The amount depends on factors such as income, the number of children and the parenting arrangement. Special or extraordinary expenses, such as eligible childcare or medical costs, may require additional contributions.
Am I entitled to spousal support after separation?
Spousal support is not automatic. Entitlement depends on your circumstances, including the relationship’s length, each partner’s financial situation and the roles each person held during the relationship. Married spouses and qualifying common-law partners may be eligible. The amount and duration depend on the specific facts of the case.
